The Individual with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act, the No Child Left Behind (NCLB) legislation, Americans with Disability Act (ADA) and innumerable state and local legislative and regulatory initiatives are designed to, at least in part, ensure equal access to learning for all children. NCLB addresses at length teacher training and qualifications, scientifically based instruction, professional development and overall accountability for all students. IDEA addresses research based instruction, speaks extensively about professional development, and, in certain areas, defines qualified providers. These provisions certainly provide partial support for the necessary foundation for children to learn—good teaching principles and sound curriculum with ongoing professional development. But where do any of these address the physical environment in which the child will learn? We have somehow overlooked a significant part of the foundation for success.
